Tracy Eso will be joined by Marianne Brown, of Orr Brown Consulting Engineers Ltd to discuss:
• What is behind these upward trends? Why are the claims occurring, and why are they so costly? What are the impacts of some of the precedent-setting court decisions on the way a building department operates on a day-to-day basis.
• Where are the largest exposures? Why can grading be difficult?
• What can be done about open permits? Can AI help?
• How will climate change impact the trend? Why?
• What can happen when a Stop-Work Order is issued, or other enforcement techniques?
• What is the best way to create a defence against these actions?

Tracy Eso will interview Jaden Hodgins, our resident Road Specialist, to explore the risks and liabilities that can arise when municipalities perform work on roads that have not yet been formally assumed. This discussion will help Councillors and municipal decision-makers better understand why the process of acquiring and assuming roads is so rigorous, and how well-intentioned actions can sometimes expose the municipality to unnecessary risk – proving once again that, in municipal governance, no good deed goes unpunished.
May 6, 2026 • 11:00 AM – 12:30 PM. ET
Using real case examples, the presenters will unpack how engineering expert reports, such as road condition assessments, signage and sightline reviews, collision reconstructions and human-factors analyses, are prepared, interpreted and applied in defending municipal road claims. Attendees will gain practical insight into the expert’s duty to the court, the applicable engineering standards that guide their work and how these reports inform liability outcomes.
From the claims perspective, we’ll examine how findings from expert reports are used in defending municipalities and how recurring themes from litigation can be turned into proactive risk-management strategies. The session will conclude with a discussion and audience Q&A to explore best practices and how municipalities can strengthen their programs before the next claim arises.
June 18, 2026 • 11:00 AM – 12:30 PM. ET

Topics to be discussed:
- How the new proposed changes to the MMS will affect municipalities.
- How documentation supporting road maintenance and activities can help or sink a municipality's case against liability.
- Creating rock-solid defences for municipalities in road liability situations.
