Municipal Liability Expert Series: DE-constructing Building Department Claims

The upwards trend of municipal lawsuits emanating from administration of building code bylaws, zoning and planning, not to mention encroachments and easements is unmistakable. More and more building departments, and the municipalities that operate them are being named in actions alleging professional negligence and at times significant liability on the part of the building department. The importance of this relatively new exposure cannot be overstated and must be addressed.

Municipal Council Matters Series: Road Assumption - Stay in Your Lane

Responsibility for road maintenance and management is one of the most frequently misunderstood aspects of municipal governance. From the claims perspective, we’ll examine how findings from expert reports are used in defending municipalities and how recurring themes from litigation can be turned into proactive risk-management strategies. The session will conclude with a discussion and audience Q&A to explore best practices and how municipalities can strengthen their programs before the next claim arises.
